The sole issue on appeal is whether the trial court properly denied the defendant's pretrial motion to suppress alleging that the defendant was seized in violation of the fourth amendment to the United States constitution when a marked police cruiser blocked the egress of his motor vehicle, which was parked with its engine running and the defendant asleep in the driver's seat. The state claims that no violation of the fourth amendment occurred because the responding officer was not engaged in an investigatory stop involving criminal activity but, rather, was checking on the defendant's well-being pursuant to the officer's community caretaking function. We agree with the state and affirm the judgment of conviction.")
