New Haven ("The defendant city of New Haven appeals from the judgment of the trial court denying its motion to dismiss the highway defect claim of the plaintiff, Valerie Vance, for lack of subject matter jurisdiction. On appeal, the defendant contends that the court improperly concluded that the plaintiff complied with the notice requirements of General Statutes § 13a-149, commonly known as the defective highway statute. See Ferreira v. Pringle, 255 Conn. 330, 331, 766 A.2d 400 (2001).More specifically, the defendant claims that the court improperly determined that (1) its answer to the plaintiff's complaint contained a judicial admission that precluded the defendant from raising that jurisdictional issue at trial, and (2) the evidence supported a finding that the plaintiff complied with those notice requirements. We agree with the defendant and, accordingly, reverse in part the judgment of the trial court.")
