Marciano (Operating a motor vehicle while under the influence of alcohol; motion to suppress; “On appeal, the state claims that no constitutional violation occurred because, at all relevant times, the arresting officer was acting in his community caretaking capacity. Alternatively, the state argues that, even if the officer was not acting in his community caretaking capacity, the defendant was not unlawfully seized because the officer’s conduct did not constitute a show of authority sufficient to cause a reasonable person in the defendant’s position to believe that he was not free to leave. We affirm the judgment of the trial court.”)
