Zoning Board of Appeals ("The plaintiff, Virginia Brown, appeals from the judgment of the trial court dismissing her appeal from the decision of the defendant, the Zoning Board of Appeals of the Town of Avon, which upheld the decision of the zoning enforcement officer to approve an application for a building permit filed by the plaintiff's adjoining property owners to build a retaining wall along the shared property line for the purpose of expanding their driveway. The plaintiff challenges on appeal the court's determination that the defendant properly held that the proposed retaining wall was not a "structure" within the meaning of the applicable zoning regulations and therefore did not need to comply with setback requirements. Because the permit approved by the defendant has expired, we dismiss the plaintiff's appeal as moot and vacate the judgment of the trial court and the decision of the defendant.")
