We conclude that the court abused its discretion in denying the petition for certification to appeal and improperly dismissed the petition under § 52-470 (b) before the pleadings were closed. Accordingly, we reverse the judgment of the habeas court and remand the case to the habeas court for further proceedings consistent with this opinion.")
