Commissioner (“On appeal, the petitioner claims that the court improperly dismissed his petition for lack of subject matter jurisdiction on the ground that he already had served his sentence, and, therefore, was not ‘in custody.’ We conclude that, with respect to the convictions challenged in the amended petition, the petitioner was not in the custody of the respondent, the Commissioner of Correction. Accordingly, we affirm the judgment of the habeas court.")
