Criminal Law Supreme Court Opinion

by Booth, George

SC20358 - State v. Ramon A. G. ("The defendant, Ramon A. G., appeals from the judgment of the Appellate Court affirming the judgment of conviction, rendered after a jury trial, among other crimes, of assault in the third degree in violation of General Statutes ยง 53a-61. The defendant claims that the Appellate Court incorrectly concluded that he had (1) failed to preserve his claim that the trial court violated his constitutional rights by omitting a defense of personal property instruction with respect to the charge of assault, and (2) waived that unpreserved instructional claim. See State v. Ramon A. G., 190 Conn. App. 483, 211 A.3d 82 (2019). We disagree with the defendant and, accordingly, affirm the judgment of the Appellate Court.")
