AC39025 - Murphy v. Murphy ("The plaintiff, Robert R. Murphy, appeals from the judgment of the trial court denying his postjudgment motion, as amended, to modify the judgment rendered in the parties' dissolution action. In that motion he sought, pursuant to paragraph 12 (d) of the parties' separation agreement, which was incorporated into the judgment, to terminate his alimony obligation to the defendant, Jamie R. Murphy, because of her alleged cohabitation with her boyfriend. On appeal, the plaintiff claims that the court applied an improper legal standard as a prerequisite for the termination of alimony under General Statutes ยง 46b-86 (b).We agree and, accordingly, reverse the judgment of the court and remand the case for further proceedings.")
