Britto, appeals from the judgment of conviction, rendered after a jury trial,
of sexual assault in the first degree in violation of General Statutes § 53a-70
(a) (1), unlawful restraint in the first degree in violation of General
Statutes § 53a-95 (a), and assault in the third degree in violation of General
Statutes § 53a-61 (a) (1). On appeal, the defendant claims that the trial court
(1) inadequately canvassed him to determine whether his waiver of his right to
counsel was knowing, voluntary and intelligent, and (2) violated his due
process rights, including his right to present a defense, when it denied his
request for a continuance to obtain a DNA expert. We agree with the defendant's
first claim and, accordingly, reverse the judgment of the trial court.")
