Standing Trial Management Order (TMO):
In all cases to be tried to a judge or jury the counsel and pro se parties shall jointly prepare and file at the trial management conference a Joint Trial Management Report. Plaintiff’s counsel shall prepare and serve on defense counsel at least 10 days in advance a draft report and defense counsel shall respond within 5 days. Thereafter, counsel shall finalize their joint report prior to the trial management conference date.

The minimum contents of this report are as follows:

  1. Joint description of the case suitable for reading to the jury panel when the case is introduced, including the names and places of residence of the parties and the date, place and nature of the incident in issue.
  2. Joint list of the factual and legal issues, which are in dispute.
  3. Joint list of pending motions, pending requests for discovery and proposed evidentiary motions.
  4. List of trial exhibits reasonably expected to be introduced by each party;
    • indexed by P plus number for plaintiff(s) and by D plus letter for defendant(s);
    • briefly describing each exhibit; and
    • indicating whether any party objects to the admission of the exhibit, and if so, stating the grounds. After the trial management conference and prior to the commencement of trial, all exhibits listed in the Joint Trial Management Report must be marked with a court clerk as full exhibits or for identification.
  5. List of all witnesses reasonably expected to be called by each party;
    • in the sequence in which they will be called; and
    • stating the name and relationship to the case (e.g. party, witness, expert) of each.
  6. A joint estimate of the number of days required for jury selection (jury trial only).
  7. Joint estimate of the number of days required for evidence.
  8. Requests for charge on issues of liability, damages and evidence on paper and computer disk (jury trial only).
  9. Jury proposed interrogatories and proposed verdict forms (jury trial only).

Report must be typed and signed by all counsel and pro se parties of record. Parallel reports from two or more parties are not acceptable. The parties must cooperate with each other to prepare a single, integrated report covering each of the foregoing matters.

Possible sanctions for failure to comply with the TMO are judgment of dismissal, nonsuit, default, exclusion of exhibits or witnesses at trial, or other sanctions.
